1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Viaje Holidays Private Limited ("Viaje", "we", "us"), CIN: U79110UP2026PTC243597, registered office at 261, Kartora, Akbarpur, Ambedkar Nagar, Uttar Pradesh 224146, India.
By downloading the Viaje app, creating an account, or accessing the Platform in any capacity, you confirm that you have read, understood, and agree to be bound by these Terms alongside our Privacy Policy, Data Protection Policy, and Community Guidelines. If you do not agree, please do not use the Platform.
2. Eligibility
To use Viaje you must be at least 18 years of age, or the legal age of majority in your country of residence — whichever is higher. You must have the legal capacity to enter into binding contracts under the laws of your jurisdiction and not be resident in a country subject to comprehensive international sanctions that would prohibit use of our services. You must not have been previously permanently banned from the Platform. Login methods and available payment instruments may vary by country in accordance with local regulatory requirements.
3. Account Security & Login
You may hold one account per verified government identity. Multiple accounts are prohibited and will result in permanent termination of all associated accounts. You are responsible for all activity that occurs under your account and for maintaining the confidentiality of your credentials. Notify us immediately at legal@viaje.in if you suspect any unauthorised access.
Login methods vary by country and may include email, mobile OTP, or supported social sign-in. All login sessions are protected by encrypted tokens and, where available, two-factor authentication. Viaje will never ask for your password, OTP, or full card details via any external communication channel.
4. Government ID Verification
Government ID verification is mandatory to access core Platform features and is the foundation of Viaje's trust model. Verification is fully digital and paperless — there is no need to upload document images. You simply select your ID type from the supported list, enter your ID number, and receive a one-time password (OTP) from the issuing authority to complete verification.
Viaje uses DigiLocker, HyperVerge, and similar government-authorised digital identity APIs for verification. These systems return only a cryptographic success confirmation to us — no personal ID data or document images are transmitted to or stored by Viaje. The raw identity verification is performed entirely within the authorised government or licensed verification infrastructure. Verification results are retained as per applicable KYC regulations (PMLA 2002, RBI guidelines). Submitting false credentials is a criminal offence.
5. Subscriptions
Viaje offers three tiers: Explorer (Free), Voyager (₹999/mo or ₹699/mo annually), and Creator Pro (₹2,499/mo or ₹1,749/mo annually). Subscriptions are billed in advance on a recurring basis. By subscribing you authorise Viaje to charge your chosen payment method on each renewal date. You may cancel at any time; your plan remains active until the end of the current billing period. Pricing may vary by currency and country. We will give 30 days' written notice of any price changes.
6. Refunds, Cancellations & Charges
Subscription Fees
Subscription charges are non-refundable once the billing period has commenced, except where a verifiable technical failure on Viaje's part prevented access to subscribed features for more than 48 consecutive hours, or where required by applicable consumer protection law in your jurisdiction.
Platform & Convenience Fees
Any platform fee or convenience charge levied on a transaction is a service charge for facilitating the booking and is non-refundable regardless of the outcome of the underlying booking.
Flight Bookings
Flight cancellations and refunds are governed entirely by the airline's fare rules applicable to your ticket. Any refund approved by the airline will be processed back to your original payment source, net of any applicable airline cancellation fees and our non-refundable platform fee. Processing time depends on the airline and your payment method.
Viaje Admin Tours
For tours and packages organised directly by Viaje, the following cancellation policy applies: cancellation more than 20 days before departure — 50% of the booking amount is refundable; 10–20 days before departure — 30% is refundable; fewer than 10 days before departure, including same-day or no-show — no refund is applicable.
Agency & Third-Party Tours
Tours listed by registered travel agencies on the Viaje marketplace are governed by that agency's own cancellation and refund policy, which is displayed on the listing before you book. Viaje is not liable for the refund decisions of third-party operators. We strongly recommend reading the cancellation terms before confirming any agency tour booking.
Individual Host Bookings
For experiences hosted by individual verified users, refund terms are set by the host and disclosed at the time of booking. Viaje may mediate disputes but does not guarantee refunds for individual-hosted experiences. See our Dispute Resolution Policy for escalation options.
7. Creator Programme
Creator Pro subscribers may monetise verified travel content. Earnings are platform-dependent and subject to minimum thresholds: video content earns ₹49–₹99 per 1,000 views depending on the distribution platform (YouTube, Facebook, Instagram, or similar); blog posts earn ₹49 per post with a minimum of 1,000 verified views; photo posts earn ₹99 per post with a minimum of 100 authentic likes. Viaje reserves the right to revise rates with 30 days' notice. Earnings are credited to your Viaje Wallet and may be withdrawn subject to applicable tax deductions.
By participating in the Creator Programme, you grant Viaje a non-exclusive, worldwide, royalty-free licence to display, distribute, and promote your content. You agree not to artificially inflate engagement metrics through bots, click farms, or purchased interactions. Content found to be fraudulent or in violation of these Terms may have its associated earnings withheld or reversed.
8. Travel Services & Third-Party Providers
Viaje offers flights, hotels, visa facilitation, foreign exchange information, and curated travel experiences through multiple channels and commercial arrangements, including but not limited to TBO, Viator, GetYourGuide, and direct partnerships. These may operate under commission, affiliate, white-label, or self-operated models. The nature of the commercial relationship is disclosed on the relevant listing or booking screen.
For third-party services — airlines, hotels, tour operators, visa agencies, and foreign exchange providers — the underlying contract is between you and the provider. Viaje's role is that of a technology intermediary and booking facilitator. Provider terms apply alongside these Terms. We do not guarantee the availability, quality, or safety of third-party services and encourage you to review provider terms before booking.
9. Local Guide Terms
Verified local guides operate as independent professionals, not Viaje employees or contractors. Guides must maintain a valid government ID, current background check consent, and an accurate profile at all times. They must honour confirmed bookings or provide at least 24 hours' advance notice of cancellation. Guides may not collect payments outside the Viaje Platform for bookings made through Viaje and agree to a 15% platform commission on each completed booking. 10. Community Rules & Prohibited Conduct
The following are strictly prohibited on the Viaje Platform: harassment, abuse, threats, or hate speech; fraud, scamming, or attempts to deceive other users; posting false or unverified travel information; sharing another person's personal data without consent (doxxing); soliciting payments outside the Platform; creating fake profiles or using bots; uploading illegal content including child sexual abuse material or terrorism-promoting content; and attempting to reverse-engineer, exploit, or disrupt the Platform or its infrastructure.
Violations result in content removal, account suspension, permanent banning, and referral to law enforcement including the Cyber Crime Cell, NCPCR, ED, Interpol, and other competent authorities. To report violations, write to report@viaje.in.
11. Your Content
You retain ownership of all content you publish on Viaje. By posting, you grant us a non-exclusive, worldwide, royalty-free licence to use, display, reproduce, and distribute your content on and in connection with the Platform. You represent that you hold all necessary rights to the content and that it does not infringe third-party rights or violate applicable law. Viaje reserves the right to remove content that violates these Terms or our Community Guidelines without prior notice.
12. AI, Platform Tools & Third-Party Services
Viaje's AI-powered itinerary planner and recommendation engine is proprietary and continuously being improved. AI-generated suggestions are provided for convenience and informational purposes only — they may occasionally contain errors, outdated information, or inaccuracies. For critical decisions such as visa requirements, flight availability, or health advisories, always verify with authoritative sources. In situations where Viaje's AI model encounters limitations, our systems use Claude AI (by Anthropic) as a fallback to maintain service quality.
Weather data is provided via a third-party meteorological API and may not be real-time or accurate for all locations. Currency conversion rates are sourced from a third-party financial data provider and are indicative only — actual transaction rates depend on your bank or payment provider. Language translations on the Platform are produced using our internal localisation system; while we strive for accuracy, human errors may occur. Please report any translation issues to report@viaje.in and we will correct them promptly.
13. Intellectual Property
All Viaje trademarks, logos, brand assets, software, AI models, database designs, platform architecture, and content created by Viaje are owned exclusively by Viaje Holidays Private Limited and protected by Indian and international intellectual property law, including the Trade Marks Act, 1999 and the Copyright Act, 1957. Unauthorised reproduction, reverse-engineering, or commercial use is prohibited and will be pursued. See our Trademark & IP Policy for usage guidelines.
14. Limitation of Liability
The Viaje Platform is provided "as is" and "as available". To the maximum extent permitted by applicable law, Viaje's total liability for any claim arising from these Terms shall not exceed the total amount you paid to Viaje in the 12 months preceding the claim. Viaje is not liable for the actions of third-party providers or verified users; decisions made based on AI-generated content; travel disruptions, safety incidents, or losses during your trip; currency fluctuation losses; or any consequential, indirect, or punitive damages.
15. Termination
You may delete your account at any time via app settings. We may suspend or permanently terminate your account without notice for material violation of these Terms, fraudulent activity, or conduct harmful to other users or the Platform. Provisions relating to intellectual property, liability, and dispute resolution survive termination.
16. Governing Law, Jurisdiction & International Users
These Terms are governed by the laws of India, including the Information Technology Act, 2000, the Consumer Protection Act, 2019, the Contract Act, 1872, and applicable rules thereunder. Disputes are subject to the exclusive jurisdiction of courts in Ambedkar Nagar, Uttar Pradesh, India, subject to the arbitration provisions in our Dispute Resolution Policy.
International users — including those in Japan, South Korea, Russia, China, the UAE, the USA, the UK, France, and other countries — retain any mandatory consumer rights under the laws of their jurisdiction that cannot be contractually waived. Nothing in these Terms limits your rights under GDPR (EEA/UK), the CCPA (California), or equivalent local statutes. For country-specific regulatory questions, contact legal@viaje.in.
